Terms of Service

1. Acceptance
By creating an account or using Brainsmith, you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you don't agree, don't use the app.
2. Eligibility
You must be at least 18 and the parent or legal guardian of any child for whom you create a kid profile. Kids do not create their own accounts.
3. Health / clinical disclaimer
Brainsmith is a brain-training app, not a medical device. The mini-games are based on research on executive function in children, but Brainsmith:
- is not a diagnostic tool;
- does not diagnose, treat, cure, or prevent ADHD or any other condition;
- is not a substitute for professional evaluation, therapy, IEP services, or medication.
If you have concerns about your child's attention, working memory, or development, talk to a pediatrician, psychologist, or developmental specialist.
4. Subscription
- Subscription is offered as $9.99/month or $79.00/year (US dollars), purchased through the App Store, Google Play, or our website.
- A 5-day free trial is offered to new accounts. If you don't cancel before the trial ends, you'll be charged for the first paid period.
- Cancellation is managed in your Apple / Google / Stripe account — see Section 9 below.
5. Acceptable use
You agree not to: reverse engineer the app, attempt to bypass authentication, scrape data, use automation to inflate streaks or scores, or use the app for anything other than a child's personal warmup practice.
6. Intellectual property
All app content (game design, written copy, illustrations, audio) is owned by Brainsmith, Inc. or our licensors. You may not copy, redistribute, or create derivative works without our written permission, except for the printable companion sheets, which you may print for personal, family, or classroom use only.
7. Account responsibilities
- Keep your password secure. We will never ask for it.
- Notify us at security@brainsmith.app if you suspect unauthorized access.
- The kid profile data you enter (display name, birth year, diagnosis flag) is your responsibility to keep accurate.
8. Termination
We may suspend or terminate accounts for violation of these Terms, fraud, chargebacks, or abuse. You may terminate at any time by deleting your account from the Parent Lounge.
9. Refunds
App Store and Google Play purchases are refunded per Apple's / Google's policies — request refunds through them. Web purchases through Stripe: we offer a no-questions-asked refund within 14 days of original purchase. After that, we don't offer pro-rata refunds for partial-month use.
10. Disclaimers
Brainsmith is provided “as is.” We don't warrant that the app will be error-free or uninterrupted, or that practice on Brainsmith will produce specific learning, behavioral, or health outcomes.
11. Limitation of liability
To the maximum extent permitted by law, Brainsmith's total liability for any claim arising out of these Terms is limited to the amount you paid us in the 12 months before the claim.
12. Governing law
These Terms are governed by the laws of [state of incorporation — TBD].
13. Changes
We may update these Terms; we'll email account holders 30 days before material changes take effect.
